Every company has set policies concerning unprofessional behavior, ethics, and discrimination. It is each person’s responsibility to do the right thing when no one is watching. However, there are always those that think they are above the law so to speak. It is an organizations responsibility to uphold their policies and reprimand those that break them. Unfortunately, often times covert harassment, such as, sexual harassment goes unnoticed or ignored until a victim comes forth.

The liability of employers based on the actions of supervisors and employees have been addressed by the United States Supreme Court in several cases. In Meritor Savings Bank v. Vinson (1986) the Supreme Court had to decide if employers could be held responsible for a supervisor’s sexual harassment action that created a hostile environment although the victim did not incur an economic loss, the court held that it violated Title VII and employer could be held accountable (Collins & Vaughn, 2004).
Sexual harassment must be stopped. Employers need to ensure employees have the means and the pathways to report harassment: whistle blower programs, open door policies, a dedicated human relations contact, etc. would be beneficial in allowing harassment to be up channeled. By ensuring employees are comfortable enough to report such events, organizations can help ensure they minimize company liability. By having a proper sexual harassment policy in place employers can ensure that professional legal action and unprofessional illegal action lines don’t become blurred (Schickman, n.d.).
