Chapter 1 IntroductionModern commercial projects are increasingly complex, resulting in complex contract documents. Complex project can likewise often result in complex disputes, which predominantly arise from the intricacy and magnitude of the work, multiple prime contracting parties, poorly prepared and/or executed contract documents, inadequate planning, financial issues, and communication problems. Chapter 4 concludes with a discussion of the conflict and project management of our study.Chapter 2 Understanding Conflict1. Definitions1.1 ConflictThe definitions of conflict applied by internationally differ significantly. There is no commonly agreed and accepted understanding of conflict. Much of the confusion has been created by researchers in different disciplines who are interested in studying conflict: On a narrow conceptual of conflict, March and Simon consider conflict as a breakdown in the standard mechanism of decision making in the organizational area, so that an individual or group experiences difficulty in selecting an alternative. [3] On a broad side, Pondy has argued that conflict can best be understood as a dynamic process underlying organizational behavior. [4] Also, Tedeschi take a middle position of viewing conflict as 'an interactive state in which the behaviors or goals of one actor are to some degree incompatible with the behaviors or goals of some other actor or actors'. [5]According to those definitions mentioned above, we can consider conflict as a situation or a type of behavior; also we shall notice that some of the definitions consider conflict to result from incompatibility or opposition in goals, activities, or interaction among the social entities. Thus, we can conclude that although those definitions differ significantly, they overlap in terms of the following elements:*It is a situation where a social, economic, political problem can not be solved under specific concept*It is a disagreement between the project and its environment, between person or between social, political, economic factors*Disagreement between two or more individuals or parties*Misunderstanding and confusion*Two or more different thinkings or ideas in a group or a community*Domination upon others for own benefit*Struggling with superstitious belief1.2 DisputeOften, people view conflict as unpleasant; however, it is not necessarily the case. Conflict can have a negative impact on performance. Basically, we can categorize conflict into two types based upon characteristic and function, namely functional conflict and dysfunctional conflict:*Functional conflict: It is a term applied to a conflict that results in progress and achievement or a better outcome than would otherwise have been expected. So it may also be described as positive or productive conflict.*Dysfunctional conflict: This term is applied to a type of conflict which prevents progress, avers achievement and suspends success. It is a destructive conflict, which blocks an organization or group from reaching its goals. No real benefits are claimed for this type of conflict.As we know, conflict can be useful and creative; however, conflicts can also quickly turn into disputes if not properly managed.
