AbstractWhen an employee believes that his rights have been violated he has the option of filing a complaint. Such complaint needs to be filed with the Equal Employment Opportunity Commission (EEOC). There are several steps to be completed for the process. The employee needs to file in the proper place, have the correct information and he has certain deadlines to meet. The EEOC will make a decision on the case. In some circumstances the employee might be able to take the case to Federal Court.Process for discrimination at workJohn believes that his rights as an employee have been violated. John wants to file a complaint against his employer for discrimination. Such complaint needs to be filed with the Equal Employment Opportunity Commission (EEOC). The EEOC have divided the discrimination into ten categories: Age Discrimination, Disability Discrimination, Equal Pay and Compensation Discrimination, National Origin Discrimination, Pregnancy Discrimination, Race Based Discrimination, Religious Discrimination, Sex Based Discrimination, Retaliation and Sexual Harassment (EEOC 2007). John will have to go in person to one of the offices or he has the option to file by mail. In the case that he has special accommodations he needs to contact the EEOC office to make the proper arrangements.Information to IncludeOn his complaint he needs to include his name, address and telephone number. He also needs to include the same info for his employer plus the number of employees if he knows the information. He also needs to include a short description of the violation that he thinks that was committed against him. He also needs to include the date the violation was committed.Deadlines to MeetJohn will need to file the charge the complaint within one hundred and eighty days of the violation. In the case that the state or local anti discrimination law also covers the violation, the time limit will be extended to three hundred days. He should contact the EEOC as soon as he suspects the violation was committed.What to Expect After Filing the ComplaintAfter filing the employer will be notified that a charge was filed against him. There will be many ways to that the charge will be handled by the EEOC.
