In an effort to fight the misuse and abuse of prescription drugs the Food and Drug Administration are trying to get new restrictions on some of the more popularly prescribed narcotic drugs that are currently on the market. In 1999 it has been found that buying of prescription drugs quadrupled, and the deaths from prescription painkillers quadrupled also; every 19 minutes somebody dies in the United States from a prescription drug overdose. Unfortunately the FDA examines the material only after they have been released to the market; this is because the FD&C Act usually does not give the FDA authority to be able to review these materials before the drug companies use them.
FD&C Act provides presiding drug approval and the marketing materials does not make the division between controlled substances, like Oxycontin, and other prescription drugs. The DEA is responsible for registering those who deal with controlled substances, how much can be produced and they also monitor the distribution of controlled substances at the retail level. It is the responsibility of each state to monitor the practice of medicine and pharmacy’s where drugs are prescribed and dispensed.
Most states have established prescription drug monitoring programs that help them detect and stop abuse. These programs examine prescription data to identify individuals, physicians, or pharmacies that have unusual use, prescribing, or dispensing patterns that may suggest a potential of drug abuse.
