FIDEICOMISOConceptos generalesFideicomiso viene de las palabras latinas fides que significa confianza y comittere que significa comisionar.Fideicomiso es una relación jurídica por la cual el fideicomitente (o aportante) transfiere bienes en fideicomiso a otra persona, denominada fiduciario, para la constitución de un patrimonio fideicometido, sujeto al dominio fiduciario de este último y afecto al cumplimiento de un fin específico a favor del fideicomisario.El patrimonio fideicometido es distinto al patrimonio del fiduciario, del fideicomitente, o del fideicomisario y en su caso, del destinatario de los bienes remanente.Un fideicomiso es un encargo de confianza, es algo tan sencillo como darle un auto a un amigo para que lo venda y que el dinero se lo entregue a mi hijo.Características GeneralesUna vez realizada la transferencia de los bienes y/o dinero, éstos dejan de ser parte del patrimonio (de propiedad) del Fideicomitente, y pasan a conformar un patrimonio autónomo que se encuentra bajo la administración del Fiduciario.Si bien el Fiduciario administra, dispone y reivindica el fideicomiso, sólo puede hacerlo para cumplir con los propósitos que se especificaron en el contrato. Así, el Fideicomiso se convierte en un fondo intangible que sólo puede ser usado en beneficio de los fideicomisarios para los fines dispuestos en su creación.El plazo máximo de duración para un fideicomiso es de 30 años, salvo en excepciones como el fideicomiso vitalicio o el que tiene fines filantrópicos, en los cuales la duración puede ser indefinida.Constitución del fideicomisoLa celebración del contrato de fiducia puede requerir formalidades especiales, tendientes a dar seguridad jurídica a las partes y conocimiento a terceros interesados.En general, los distintos países admiten que el fideicomiso se puede constituir por contrato o por testamento.
