Party control is essential to the adversary system because it allows the parties to be in control of their situation and responsible for their outcome.
4 What is the role of a judge in the adversary system of trial?
The role of the judge is to be an impartial umpire that does not take sides. The judge also ensures that rules of evidence are followed and that court room procedure is also monitored. The judge decides questions of law for cases brought before them while they clarify issues of ambiguity. The judge directs the jury if there is one and also provides a question on facts if there is no jury in a civil case or magistrates court. Lastly the judge provides remedies and sanctions.
