John is an employee in a private sector organization. He wants to file a discrimination complaint against his employer. John is a former employee that feels discriminated against, but the scenario does not explain the type of discrimination that John was subjected to. The basis of this scenario is to analyze an employee which would like file a discrimination complaint against his/her private sector organization. Secondly, explain the civil litigation process for such a claim. Litigation is the process in which cases are brought and prosecuted in the court system. In the case of a discrimination suit, the civil litigation process begins with filing the complaint with the Equal Employment Opportunity Commission (EEOC) and, if necessary, proceeds from the state level up to the United States Supreme Court. The private sector is a business that is not a governmental agency and represented by private companies, companies. A discrimination complaint consists of an accurate and evidential claim (or claims) of illegal treatment or activity on the basis of an individual's or group of individuals' race, sex, religion, national origin, physical disability, [or] age. Discrimination in the workplace is complicated to identify; there are several federal laws that prohibits job discrimination. In the hiring and terminating process, employers need to be fully aware of the correct legal course of action to avoid discrimination practices. This is an extremely serious situation. John is an employee in a private sector organization. It is the responsibility of that organization to hire candidates that are qualified without discriminating. He wants to file a discrimination complaint against his employer. Based on this scenario, the entire discrimination complaint and civil litigation process will be discussed as it applies to an employee and employer in a private sector organization.The discrimination complaint that Johns is filing against his employer has a process. Employees of a private sector organization must file a charge or claim with the Equal Employment Opportunity Commission (EEOC) if they believe that they have been discriminated against. Private sector employees must file the claim within 180 days of the event, after the complaint is filed with EEOC, within 10 days the employer is served notice of the charge. The next step of the process is reconciliation with the Equal Employment Opportunity Commission (EEOC). The Equal Employment Opportunity Commission (EEOC) consists of five Commissioners and a General Counsel appointed by the President and confirmed by the Senate.
