Every process born on an idea. Here is when most organizations have their origins.
Like every production process, music production is protected from the idea to
distribution and sharing. Let’s start from ‘songwriting and composition’. ¹According to
the law, the lyrics that are written by a songwriter are considered literary works and
protected by copyright. Copyright is the right owned by the creative artist to utilize or
let use his composition by whoever needs with the proper established agreements.
Written lyrics represents 1/3 of copyrights ownership as well as musical composition
and arrangement. We could see the backing chord and its progression used in the

As a worldwide
matter, copyright protection gave birth to the ‘ World Intellectual Property
Organization ‘ ( best known as WIPO) in Geneva in 1967, an agency which involves
the United Nations in the Intellectual Property copyright protection worldwide.
According to the copyright protection legislation set in 1988 with ‘ The Copyright Act
‘ ( or CDPA ) further changes, for example, copyright ownership on music works
would last till 70 years after artist’s death or, if the artist was unknown, for 70 years
from the work
creation. It also protects copyright on films and broadcasts. There was when it was

In the past times, with the growing music business influence, was born the necessity
of recording and selling music. According with customers necessities, music had to
be recorded using tangible devices such as vynil, tapes, CD’s, etc. to duplicate and
Everytime a song is played using these supports , is created a ‘ mechanical ‘ royalty .
The Mechanical Copyright Protection Society ( MCPS ), born as Mechanical
Copyright Licenses Company ( MECOLICO ) in 1911 ‘, was the organization
responsible for ‘ mechanical reproduction ‘ incomes and its copyright protection ( in
UK ). Everytime a record label decides to record ‘ your ‘ songs in a physical format,
has to pay fees to MCPS to obtain the license to duplicate and recording it.
Royalties will be shared between the organization ( which protects your work ) and
you, the artist. Not to be confused with Phonographic Performance Limited ( PPL )
which collects royalties for record companies and performers from ‘ Public sharing ‘
through media such as TV, Radio, internet .
Performing Right Society ( PRS ) which collects royalties on behalf of the
songwriters, composers and publishers who controls the rights of the song mainly on
the public live sessions ( ex. Tours ).
Today ,when a song is performed on radio, TV or internet channels and live, royalties
will be collected, on behalf of the copyright owner, by an organization best known as
Performing Right Society for Music ( PRS first, PRS for Music from 1997 when it got
together with MCPS ). Just to be clear, I’m going to use Adele’s cover of the song
‘ Make you feel my love ‘ from the album ‘ 19 ‘. In matter of royalties, in this case,
PPL is responsible to collect them on behalf of the recording company which owns
Adele’s recording rights and PRS for Music has to collect royalties on behalf of the
publisher that controls Bob Dylan’s rights on the song ( who wrote it ).
PRS for Music was born also for facing the advent of digital era in which physical
music formats sales were going to decrease.
But which are the benefits and issues of music digital formats and sales?
