The Americans with Disabilities Act of 1990 (ADA) was written by legislation to protect the disabled against the barriers of employment discrimination in both the federal and private employment genres. The ADA defines disability as; (a) a physical or mental impairment that substantially limits one or more major life activities of an individual, (b) a record of having such impairment, (c) or being regarded as having such impairment.Congress amended Title VII in 1978 by passing the Pregnancy Discrimination Act (PDA) and made it clear that discrimination based on pregnancy is unlawful sex discrimination. This legislation reversed the Supreme Court's Gilbert decision in 1976. Congress passed the Civil Rights Act of 1991 which overruled several Supreme Court decisions rendered in the 1980s that had made it more difficult for plaintiffs to prevail in their employment discrimination suits and to recover fees and costs when they won their lawsuits (EEOC 2009). The amendment stated that parties can request jury trials and those successful plaintiffs can recover compensatory and punitive damages in employment discrimination cases. It can be seen on one hand, by the penalties imposed and the corrections made to combat discrimination. On another hand it can be seen by its more secondary impacts and what it has done to change the shape of the workplace. Today's everyday mix of people in the workplace is a direct result of the impact of Title VII. Since the act was created in 1964, employers have an increasingly diverse mix of employees. People of all races regardless of age, sex, or physical characteristics now inhabit Professional jobs that were the domain of white males in the past. At the beginning of Title VII, there was reluctance and years of habits that needed to be addressed and overcome. By use of Affirmative Action, different racial groups were able to work together and employees slowly became adjusted to working with people from different backgrounds. The process was not without conflict and resentment but as employers stuck with the Affirmative Action program, a new norm evolved in the workplace. Individuals were viewed as doctors or teachers instead of as an African American female or a Caucasian male.Covered under Title VII and its amendmentsTitle VII of the Civil Rights Act of 1964 sought to correct the unlawful practices of discrimination in employment.
